      Thanks Luanee,

Yeah, my older kid is in Primary 3 now and my daughter will be going to the same school next year. When my kid applied for the neighbourhood school, there was no balloting as it was within 2km of the grandparent's house. However, at that time, byeond 2km there was balloting but the enrolment numbers were just marginally above the available vancancies.

It did not occur to us that this could potentially be a problem. However, should we change back to our own address, would the govt thinks that I left my registered address as it is for the purpose of getting into a particular school?
That means u did indeed used the grandparents' address to secure a place for ur first kid. Mmm... I am not sure the implications of changing ur address now

I own a HDB house and I just bought a fully completed private condo. (Currently tenanted)

Being I will permanently willing to stay in my private property, I would like to apply to the primary school near to (with 1km) it for my daughter 2011 primary 1 education.
(I need to apply during July 2010). But my HDB house MOP (Minimum Occupation Period) is ending only at July 2011. So I can move in to the new house only at July 2011.

I have all the proof for the purchase of private property.

My question is am I eligible to apply to the school under within 1km range using my new private property address?

If you own a flat bought directly from HDB, or a resale flat bought from the open market under the CPF Housing Grant Scheme, you can invest in a private residential property, provided you have completed the minimum occupation period of your flat.

:? can buy private property before MOP is up?

            for your earlier post:-

I prepare to move near to the school. But after moving still my child may not get admission. so i have below plan, is that leagl?

            1. Currently i own a HDB house. My target school is quit very far from my house.
            2. I plan to rent a house witin 1km to the school to get priority registration. ofcourse I will change my IC and will physically plan to stay in that address.
            3. If it is sucessful, then I plan to buy a propery within 1km from the school and will move to my new house.
            Is it legal?
your MOP is end July 2011 (as per your later post).
you need to register your child by July 2010.
you intend to rent a place for priority registration - i think MOP means physically staying at your owned HDB, therefore, i don't think you are allowed to rent and stay at the house or change your address to the house address that is within 1km from your target school prior to registration. so while using a rented house address that you intend to stay for registration is legal, i don't think renting a house when your MOP is not up, is legal. you better check with HDB.

              hi

sorry i think there is confustion. I have changed my plan.

In order to put my question in simply, legally the parent can use the private property address if the TOP is before p3.
Is the same rule apply for completed private property?

              Note:
I bought my HDB flat in 2008 from open market. Ofcourse i’m allowed to buy private property, HDB rule says i must stay in my HDB house for minimum 3 years and The flat can’t left empty, can’t sublet. One option is i need to sell my HDB flat. but i don’t want to do that.

Just i bought a private property this month which is 1km near to school.
but i can’t move in because i must stay upto 2011 in HDB flat.
but i want to use my new property address for my daughter P1 in registration 2010.
              is it legally possible.

              thanks in advance.

the rationale for allowing parents up to before p3 to move into their property is because the property is not completed.
for completed property, the applicant has to be physically staying there to use that address.

registration aside, the criteria that HDB requires you to fulfill is in bold above. but your registration is in jul 2010 but your MOP is up til jul 2011. hence, it is not possible for you to change your address (for the purpose of P1 registration) to either any rental address or completed private property address without contravening HDB's ruling. you have to check with HDB on that.
i don't know how it works with buying of resale flat without grant, but if buying of flats direct from hdb or with grant, should hdb find out that the occupier has break their ruling, HDB has the right to take back the flat.

There was a time when I was not working and I spent most of my time at my parents' place. Coincidentally, that was also the time when my first kid needed to register for P1. Hence, it was more convenient to have my registered address at my parents' place since I was there and my kid also took the school bus from there. My kid still go back there after school everyday to be looked after by the grandparents.

                    hi ssbabudilip,

If you bought from open market, and took no grant nor HDB loan, you only need to stay there for 1 year before you can sell it (and I take it to mean that you can sublet it with HDB approval). I’m not sure why there would be a 3 year min occ period - I thought if you were bound by such restrictions, you would not have been able to get the flat in the first place.

                      Hi!

The Minimum Occupation Period is used to calculate your eligibility to sell or rent the flat. In your case, your MOP ends in July 2011. This means if you stay in your HDB flat for 3 years, the MOP ends in July 2011. You will be eligible to sell or rent your flat after July 2011.

However, if you choose to stay in your private property, you can still do so. You will not be able to rent out your HDB flat, though, since you have not fulfilled the MOP. Where are you staying currently? Assuming you have stayed in your HDB flat since you bought it in 2008. Further assume that you plan to stay in the private property starting Jan 2010. By then, you will have stayed in your HDB flat for one and a half year. So, you are left with another one and a half year before you meet the MOP of three years. If you plan to stay in the private property for the full 6 years of your child's primary education, these 6 years do not count to the MOP.

Your child starts P1 in 2011, and completes her primary education in 2016. Hence, assuming you move back to your HDB flat in Jan 2017. You will need to stay there for another one and a half year before you are LEGALLY allowed to rent or sell your HDB flat.

That is the MOP. The Jul 2011 is a guide to let you know that, should you be staying in the HDB flat 100% of the time, the MOP ends then. However, if you do not sty in the HDB flat, the period that you are not staying there do not count towards calculating the MOP.

                      Hope the above clarifies.

As what jedamum mentioned, HDB flats are meant to be lived in. You need to have valid reasons why you are not staying in the HDB flat. I don't think HDB will accept reasons such as P1 registration.

Like what the other forummers mentioned, check with HDB.

Correct me if I’m wrong but I think the Minimum Occupation Period (MOP) is just a guideline. Don’t think the authorities will enforce on it.

For my case, I’ve bought a new flat and sold it off upon reaching 5 fives. Question: Did I stay there during this period? Yes…but less than a month in those 5 years. You just need to write to them for confirmation so as not to disrupt your sales process.
